1. Introduction & Acceptance

By accessing www.andern.us and purchasing products from Ändern Motorsport ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our services. We are headquartered in Phoenix, Arizona with a satellite office in Bern, Switzerland and specialize in bespoke automotive components.

2. Custom & Bespoke Products

  • Final Sale Nature: All wheels are custom-forged and engineered to your vehicle’s specific requirements. Once the production process begins following your 15-minute consultation, the order is considered a "Bespoke Contract" and is non-cancelable and non-refundable.

  • Fitment Responsibility: While we provide a Fitment Guarantee based on the data provided during your consultation, the customer is responsible for ensuring the vehicle has not been modified (e.g., aftermarket suspension or spacers) in a way that would interfere with the engineered specifications.

3. Shipping & Dropshipping Disclosure

  • Fulfillment: We utilize a global dropshipping model to deliver high-performance components directly from our manufacturing partners.

  • Lead Times: Delivery typically takes 5–8 weeks. These are estimates and not guaranteed deadlines, as custom forging and international logistics can be subject to unforeseen delays.

  • International Shipments (DAP): All international orders are shipped Delivered at Place (DAP). The customer is the "Importer of Record" and is solely responsible for any local import duties, VAT, or brokerage fees.

4. Arizona Taxes & Compliance

  • Transaction Privilege Tax (TPT): As an Arizona-based business, we collect TPT on all orders shipped to an Arizona address in accordance with Arizona Department of Revenue guidelines.

  • Out-of-State Sales: For customers outside of Arizona, we collect sales tax based on the "Destination Sourcing" rules of your state, provided we meet that state’s economic nexus thresholds.

5. Warranty & Liability

  • Structural Warranty: All wheels carry a 3-year limited structural warranty against manufacturing defects.

  • Cosmetic Disclaimer: This warranty does not cover "curb rash," chemical damage from improper cleaners, or road hazard damage.

  • Limitation of Liability: To the maximum extent permitted by Arizona Revised Statutes Title 44, Ändern Motorsport shall not be liable for any indirect, incidental, or consequential damages resulting from the use or installation of our products. Professional installation is required.

6. Dispute Resolution & Governing Law

  • Governing Law: These terms are governed by the laws of the State of Arizona.

  • Venue: Any legal action or dispute shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona.

  • Arbitration: We encourage resolving disputes through informal negotiation during your post-purchase consultation before seeking formal legal remedy.

7. Changes to Terms

We reserve the right to update these terms at any time. Continued use of the site after changes constitutes acceptance of the new terms.
